Terms of Service
These Terms of Service ("Terms") apply to the services, products, and content (collectively, the "Service") offered on this website by the Wikitopia Institute, ISH ("Institute"). Users of the Service ("Users", or individually, "User") are required to use the Service in accordance with these Terms.
1. Application
- 1. These Terms apply to all relations regarding the use of the Service between Users and the Institute.
- 2. In addition to these Terms, the Institute may establish a variety of rules, provisions, and notices ("Individual Provisions") regarding the use of the Service. These Individual Provisions, regardless of their names, constitute a part of these Terms.
- 3. In the event of any conflict between the provisions of these Terms and those of the Individual Provisions, those of the Individual Provisions will prevail unless otherwise specifically stipulated in the Individual Provisions.
2. Account
- 1. An account is needed to access some parts of the Service. To register for an account, the User must accept these Terms and apply for registration through the process prescribed by the Institute. The registration will be complete when the Institute approves the application.
- 2. In cases where the Institute deems the registration to be inappropriate, the Institute may refuse to approve the User's registration application, and is not obligated to disclose the grounds for its decision.
- 3. The User is responsible for appropriately managing the User ID (the email address registered by the User) and password tied to their account. The Institute will consider any valid login attempts using a User ID and password combination matching a registration record as attempts by the registered User.
- 4. The Institute is not responsible for any damage caused by the use of the User ID and password by a third party, except in cases where the Institute has acted with gross negligence or malicious intent.
- 5. Users can delete their registered accounts by following the procedure prescribed by the Institute.
3. Personal Information
- 1. The Institute will appropriately handle personal information obtained through the use of the Service, in accordance with the Institute's Privacy Policy regarding the Service.
4. Age Requirements
- 1. Children under the age of 13 may not use the Service. Individuals between 13 and 18 years of age may only use the Service with involvement of a parent or legal guardian who accepts these Terms.
- 2. In addition to the above, Users must meet the requirements stipulated in the Privacy Policy regarding the Service.
5. Prohibited Acts
- 1. In using the Service, Users must not engage in the following acts:
- 1. Acts that violate laws or public order and morals
- 2. Acts related to criminal activities
- 3. Posting or transmitting content on the Service that includes or is deemed by the Institute to include the following expressions:
- 1. Excessively violent expressions
- 2. Explicit sexual expressions
- 3. Expressions corresponding to child pornography or child abuse
- 4. Expressions leading to discrimination based on race, nationality, creed, gender, social status, family origin, etc.
- 5. Expressions that may encourage or facilitate suicide, self-injury, or drug abuse
- 6. Other anti-social expressions that cause discomfort to others
- 4. Acts that could interfere with the operation of the Service
- 5. Providing benefits directly or indirectly to anti-social forces in relation to the Service
- 6. Acts that destroy or interfere with the function of the Institute's, other Users', or third parties' servers or networks
- 7. Infringing on intellectual property rights, portrait rights, privacy, honor, or other rights and interests of the Institute, other Users, or third parties
- 8. Acts that aim to cause disadvantage, damage, or discomfort to the Institute, other Users, or third parties
- 9. Impersonating the Institute, other Users, or third parties
- 10. Collecting or accumulating personal information about other Users
- 11. Harassment or defamation of other Users
- 12. Spreading false or misleading information
- 13. Unauthorized access or attempts thereof
- 14. Accessing the Service using automated means such as bots or scripts (except in cases permitted by the Institute)
- 15. Sales activities, advertising, soliciting, or other acts with profit-making aims (except in cases permitted by the Institute)
- 16. Acts aimed at engaging in sexual acts or obscene behavior
- 17. Acts aimed at meeting or dating unknown persons of the opposite sex
- 18. Religious activities or solicitations for religious groups
- 19. Other acts deemed inappropriate by the Institute
6. Copyright
- 1. Users may post or upload using the Service only information such as text, images, and audio for which they have the necessary intellectual property rights, or for which they have obtained permissions from the rights holders.
- 2. Copyrights for text, images, audio, and other works posted or uploaded by the User using the Service belong to the User and other existing rights holders. However, the Institute may use the posted or uploaded text, images, audio, etc., to the extent necessary for the following purposes, and the User shall not exercise moral rights in connection with this use.
- 1. Improvement, correction of defects, and publicity of the Service
- 2. Academic research and contribution to society
- 3. For-profit and non-profit activities contributing to city development and urbanism
- 3. Except as stipulated in the preceding paragraph, all copyrights and other intellectual property rights for all information related to the Service, including the Service itself, belong to the Institute or the rights holders who have granted permission to the Institute, and Users may not reproduce, transfer, lend, translate, modify, reprint, publicly transmit (including making it possible to transmit), send, distribute, publish, or commercially use without permission.
7. Suspension of Service Provision
- 1. In cases where the Institute performs maintenance on or updates the computer systems for the Service, or in cases where the Institute encounters difficulty in providing the Service or deems it difficult to provide the Service due to accidents, natural disasters, etc., the Institute may suspend or interrupt all or part of the provision of the Service, without prior notice to Users.
- 2. The Institute shall not be liable for any disadvantages or damages incurred by Users or third parties due to the suspension or interruption of the provision of the Service.
8. Changes in Service Content
- 1. The Institute may change, add, or discontinue the content of the Service without prior notice to Users, and the Institute shall not be liable for any damages caused to Users by such actions.
9. Prohibition of Reuse
- 1. Unless otherwise prescribed by the Institute, Users may not use the Service for purposes other than those for which they are provided.
10. Prohibition of Transfer of Rights and Obligations
- 1. Without the Institute's prior written consent, Users may not transfer, or provide as collateral, the rights or obligations based on these Terms to third parties.
11. Usage Restriction and Account Deletion
- 1. In cases where the User has violated any provision of these Terms or has shown prolonged inactivity, or in other cases where the Institute deems the use of the Service by the User to be inappropriate, the Institute may restrict the User's use of the Service in whole or in part, or delete the User's posted data or account, without prior notice.
- 2. The Institute shall not be liable for any damages caused to the User by the actions taken by the Institute based on this article.
12. Disclaimer of Warranty and Disclaimer of Liability
- 1. The Institute does not explicitly or implicitly guarantee the absence of defects (including safety, reliability, accuracy, completeness, effectiveness, suitability for a specific purpose, etc.) in the Service, either in fact or by law.
- 2. The Institute shall not be liable for any damages incurred by the User due to the Service, except in cases where the Institute has acted with gross negligence or malicious intent. However, this disclaimer does not apply to contracts between the Institute and the User regarding the Service (including these Terms) that fall under the Japanese Consumer Contract Act.
- 3. Even in cases covered by the exception clause in the preceding paragraph, the Institute shall not be liable for damages (including those that the Institute or the User had anticipated, or may have anticipated) arising from special circumstances, among damages incurred by the User as a result of default or tort due to the Institute's negligence (excluding gross negligence).
- 4. The Institute assumes no responsibility for transactions, communications, disputes, etc., between Users or between Users and third parties arising from the Service.
13. Notification or Contact
- 1. Notification or contact from the Institute to the User will be made by way of posting on this website or sending an email to the User's registered email address.
- 2. The Institute will consider the User to have been notified or contacted, at the time of posting in cases where the communication is made by way of posting on this website, or at the time of email transmission in cases where the communication is made by way of sending an email to the User's registered email address.
14. Revisions to the Terms of Service
- 1. The Institute may revise these Terms, in cases where the revision to the Terms conforms to the general interest of Users, or in cases where the revision to the Terms is not in opposition to the purpose for which Users use the Service, and the revision is reasonable considering the necessity of the revision, the appropriateness of the content after the revision, and other circumstances related to the revision.
- 2. The Institute will notify Users in advance of revisions to these Terms as stipulated in the preceding paragraph, indicating the intent to revise the Terms, the content of the revised Terms, and the effective date of the revised Terms.
- 3. If the User continues to use the Service after the revised Terms take effect, the Institute will deem the User to have accepted the revised Terms.
15. Governing Law and Jurisdiction
- 1. Japanese law shall be the governing law regarding the interpretation of these Terms.
- 2. In the event of a dispute related to the Service, the court with jurisdiction over the Institute's headquarters shall have exclusive jurisdiction.
